Texas Business & Commerce Code Chapter 114 establishes training and recordkeeping duties for covered commercial lodging operators. This page summarizes the law; it is not legal advice or a substitute for reviewing applicable requirements.

Who is covered?

Under §114.0001, a commercial lodging establishment offers more than 10 rooms to the public for temporary lodging for a fee. Under §114.0051, the operator must require each directly employed employee to complete training annually.

The OAG overview uses “10 or more rooms.” This summary follows the statute’s “more than 10 rooms” definition. Establishments at the boundary should obtain current guidance. Training is encouraged regardless of size.

Signage, reporting, and local rules

§114.0053 requires the OAG-prescribed employee sign: at least 11 × 17 inches, at least 16-point type, separately in English, Spanish, and each other primary language spoken by 10% or more of employees, in a location easily visible to all employees. Harbor Alliance program signage does not replace the statutory sign.

§114.0054 prohibits discipline, retaliation, or discrimination for good-faith reports of suspected trafficking to the operator, law enforcement, the National Human Trafficking Resource Center, the Attorney General, or another appropriate authority. Chapter 114 does not preempt local ordinances; under §114.0003, a more stringent local rule controls to the extent of a conflict.

Records remain the operator’s responsibility.

Training completion does not, by itself, establish compliance with every legal duty or guarantee safety. Our planned OVIS integration is intended to reduce recordkeeping administration, not transfer the operator’s responsibilities.
